Correct me If I am wrong
out of 45K members let's assume 22.5 K are EB2 and 22.5 K are EB3.
Even If 11.25K (EB2)+11.25K (EB3) = 22.5 K (Total) contributes $25 Each Problems gets solved ... but the catch is ....
Even 11.25 K EB2 members are not contributing because they don't have to as their problem is solved
Even 11.25 K EB3 members are not contributing because they are not sure even with this contribution their problems gets solved.
Many people are saying that EB3 members are not contributing that's why you are lagging etc...
EB3 Members who contributed are feeling the pain because even after contribution they are not getting the results and EB2 members who didn't contributed are getting the results...

VISA BULLETIN FOR JUNE 2009 sets back EB2 priority back to 01JAN00.
Some thing needs to be done. The easist will be not counting ebdependents in ebquota. This should be very easy. There is no INA law linking ebquota with ebdependents.

I am also on the same boat.Application filled on 5th June still no news,checks have not been cleared yet.

Your employer do NOT have to give LC or Original 140 to you for invoking AC21. If you have 485/AOS receipt ( which is your personal property) and you got a copy of 140 receipt ( if not approved) / copy of approval notice and that 485 shows more than 180 days from RECEIPT DATE you are good to switch Jobs.
Just keep in touch with Attorney in case if any RFE comes - so that he contacts you now instead of your previous employer. If you are a self-filer or have hired your own Lawyer even you dont have this headache.
When changing Jobs - be responsible on your own , so that you can respond to the RFE satisfactorily. Also make sure you get a letter from new employer that they want to recruit you on a permanent basis quoting your Salary and Job description.

My PD is Sep 2002. There are different limits:
Break even limit
Fatigue limit
Endurance limit
I am on last one :)

Is this rally still on? On 14th? Then please update the first post on this thread which still says July 7th - it is confusing.
Also, considering that there are only 4 more days to the rally if it is on 14th, we need considerably more publicity in the media and on blogs on this.
This rally will be a watershed event because as far as I know, this would be the first of its kind by skilled, legal immigrants and it should get the media attention that it deserves.

The receipt no. had SRC***** in it and when i looked it up online i saw a note stating " your applicaiton is with our Texas Center". I did send it to NSC on Jul 2.
I understand that. What I wanted to know was what number you have? SRC or LIN? And also to confirm, if it was cashed by TSC? and not the case that it was cashed by NSC and then scheduled to be transfer to TSC?

This is what I don't understand. Priority dates are set so only applications before that date can be approved. Processing dates are not set in that sense of the term.
All uscis does every month when they publish processing dates is look at the Receipt date of the application still pending at the time and publishes that info. So in that sense, "not moving the processing date" does not make sense. Unless you mean they deliberately reduce the number of hours they work so fewer applications are processed.
USCIS deliberately can do many things and is doing. It can transfer files from one center to ther and inroduce the delay. During July 2007 fiassco, many members of IV experienced that files were flying between nebraska and california centers without apparent reason. If you have followed processing dates in past you would surely have obeserved dates not moving at all for months. Does that mean nobody was working at USCIS at that time? No.. What it means - " We have heavy work load and we want to go in particular direction and so we are delaying" - in terms of USCIS. In our interpretation - USCIS does not work and want us to rot forever.

Hi Maag,
I did not land yet. Planning to give away canada PR. Its too much of risk being on AP/EAD. I have too many things on stake in US like Home, Nice Jobs for me and my wife..don't want to risk all that.
As it is i don't think I will ever settle in Canada, i had applied at a time when my US labor was stuck in backlog for almost 5 years but now things have changed and if i ever have to leave US I think I will go back to my home country; as it is after being here for 8 years I don't have energy to start all over again in some new country.
What have you decided? do you know the procedure to get landing fee back?
I am also giving up canada PR, i had also applied at the time my green card process was not moving, also i don't have any job offer as of now in canada, i don't want to leave what's in hand in hope of something similar (can't say better). If someone ports from EB3 to EB2, then they deserve to be in the front of the queue. Nothing wrong in the process..
If someone ports from eb3 to eb2 they should get the priority date of the day they were eligible to file an eb2 and not be able to carry the date from eb3.
Porting makes sense in a family based visa where your petitioner can file for an application while he is still a green card holder and then becomes a citizen which upgrades the beneficiary's category as well.
On an employment visa you file for an eb3 when you are eligible for an eb3 job, you file for an eb2 when you are eligible for an eb2 job. Why would you be able to jump ahead in the eb2 line when you were clearly did not have an eb2 job ? Just because you filed an application at some point of time in eb3 and waited a decade to get a better job doesn't mean someone else has to pay for your (pick one - laziness, ineptitude, lack of skill or lack of knowledge).
Most of IV Core is made of eb3 applicants and therefore there has never been any push from the core on this matter. And as someone said .. You ARE eating my lunch..

Do we need to include a cover letter ?
Also I am sending the following documents.
1) copy I-485 receipt notice
2) copy of EAD (front and back)
3) two color photos
4) Filing fee check $340
5) Mailer stub received from previous EAD.
Am I missing anything else?
A cover letter even though not required, is always a good idea. Do mention in bold that you want the new EAD to start from mm/dd/yy which is when your current one expires, otherwise it could start from the approval date and you could lose 2-3 months. I'd keep the cover letter short, just 2-3 lines plus doc list.

My husband received CPO mail on 08/04, welcome mail on 08/05, soft LUD on 08/06 and approval notice sent mail on 08/09 but dated 08/08 in USCIS status. Hoping to have the GC in hand next week.
Anyone who has the same chain of events or received GC for CPO mail on 08/04 or later?
Same exact sequence of events happened to me. I am sure we will have our cards this week God willingly.

I am flattered and extremely grateful to all of you for thinking about this. However, Immigration Voice has made it a policy to use the funds available for advocacy and in order to do that we have chosen not to reimburse expenses for anyone. We will in future, change this policy and reimburse expenses for travel and stationary if it is affordable to do so without running short on funds for advocacy. There are a lot of people who have spend money from their pocket on this effort. Recently, Gopal, Tamsen, Anand and many other had spent money to organize rally and make the banners for San Jose rally, Jay have traveled to DC multiple times on his expense, Himanshu, Vineet, Pratik, Ashish, Nagaraj, Naren, Alok and other members of the core team have all spent resources from their pocket. And there are a lot of good non-core group members who have kept the faith and have spent from their pocket and writing all their names will fill up many pages of this thread.
If I am unable to get reimbursed then I would not regret at all because I truly believe that every penny was worth the effort and I am lucky that I could do this for myself and this community. This community is not about one person, it’s about all of us and it’s about this broken system. I am nobody as an individual but we are collective a very big community. We need to stand up for ourselves so that few lawmakers will not take pride in beating us down by their false rhetoric on the Senate floor. As you have witnessed lately, these lawmakers think that beating us down is like a low hanging fruit and every time they need to improve their ratings, they could simply do some empty rhetoric. And when we all stand-up for ourselves, together, it will be time for this bigotry to end.
Please do not collect or send funds with the intention of reimbursement for me or any particular core group. Please continue contributing to our organization in whatever capacity you can. Please become more active in the state chapters. In the beginning the response will be slow and sometimes discouraging. But if you are persistent, you will be able to motivate others in your area and raise the level of participation of other members. Please stand up for yourself and not expect lawyers or employers to do “something” for you. For too long a lot of people have taken advantage of this community. Some lawmakers have even taken pride in beating us down, knowing well that we do contribute towards the progress and pay the taxes and do our due share in the society. We all need to realize that it doesn’t end with whatever we have been doing at our jobs, because if we want our issues to be addressed we have to organize and act as community. And there is nothing wrong with organizing a community. We all have witnessed our strength when we all collectively acted as a community responding to the recent visa bulletin fiasco. We won because of the participation of everybody who sent flowers, participated in the rally and participated and helped behind the scenes in these activities.
So please keep this in mind. For the core group, your involvement is as important as your contribution. Participating in phone campaign, fax campaign, flower campaign, street protests, video campaign -- all this is a billion times more important for our success. Contributions are also welcome but your presence on the street and your face on the videos is of paramount importance for coming months. Please follow every single action item both on this site and the ones you get in the newsletters. In order to get newsletter, keep the email address and contact information in your profile (of IV account) up to date.
My wife and I received our green cards in June. But all it doesn’t end with a green card. We will all continue to have same set of problems. This IV generation will be facing same set of problems in the future, regardless of the country of origin. The question is, do we form a new organization from scratch whenever a problem knocks at our door or do we continue to be part of an effort which can take on any challenge for this community. So if you have received your green card or if you are at any stage of the process, in the long term, we should all act as a community to see greater things happen for all of us.

We all need to realize that it doesn’t end with whatever we have been doing at our jobs, because if we want our issues to be addressed we have to organize and act as community. And there is nothing wrong with organizing a community. We all have witnessed our strength when we all collectively acted as a community responding to the recent visa bulletin fiasco. We won because of the participation of everybody who sent flowers, participated in the rally and participated and helped behind the scenes in these activities.
So please keep this in mind. For the core group, your involvement is as important as your contribution. Participating in phone campaign, fax campaign, flower campaign, street protests, video campaign -- all this is a billion times more important for our success. Contributions are also welcome but your presence on the street and your face on the videos is of paramount importance for coming months. Please follow every single action item both on this site and the ones you get in the newsletters. My wife and I received our green cards in June. But all it doesn’t end with a green card. We will all continue to have same set of problems. This IV generation will be facing same set of problems in the future, regardless of the country of origin. The question is, do we form a new organization from scratch whenever a problem knocks at our door or do we continue to be part of an effort which can take on any challenge for this community. So if you have received your green card or if you are at any stage of the process, in the long term, we should all act as a community to see greater things happen for all of us.
