I see three groups emerging in this disucssion:
1. We applied labor in 2002/3/4. Therefore, GC should be PD based.
2. We applied labor in 2001/2/3 but had to reapply in 2005/6, therefore GC should be based on number of years in US.
3. Govt should "end retrogression" and give green cards to everyone.
I can understand the rationale of all three groups: they want things to work the way it will benefit them. In some way the rationale of first two groups can be justified also.
What I am having trouble with third "end retrogression". What does it exactly mean? There are only limited number of GC's per country. Are you talking about merging all the countries into one queue? I am not sure if ROW applicants will like that because that might set them back. Are we talking about raising the per country caps? How do you accomplish this "end retrogression".

And while you guys are at it also send some flowers to FBI to clear Namechecks FIFO, to DOL to approve PERM petitions FIFO etc.
Go spend those $50 at Flowers.com folks. Start writing to Senators, collect money, do the lobbying etc. Who's stopping you?
Or do you want logiclife, pappu and rest of the IV core to do it PRO BONO for you?

GC Status:
I am seeing that reedandbamboo is considering for EB2 only. We have to include EB3 too for law-suit. I beleive that we will have more than 1000 people if we inlcude all categories.
I will give 200$( 100$ for me and 100 $ for my wife)
Ofcourse all categories are included...EB2/EB3, I/C/ROW...anyone who is unhappy with USCIS random processing and retrogression of the dates is welcome to join the fight.
Whoever thinks they are in: please send ur Name, Ph# and email ID to GCSTATUS or me.
We are not collectiong money yet..just a pledge. As soon as we hit the required # of pledges, then we start the money collection. This will ensure that it is not one those efforts that starts, but gets buried due to people not participating. If we do not have enough people interested to fund a lawsuit...we don't move forward....simple !!! The helpless situation we have been put into...has to be backed by numbers.

Thanks everyone for sharing your experiences. I plan to take care of the Canada landing on the 4th of July. Will be in Canada for a week and spend some time with friends and family. Hopefully all goes smooth. I plan to re-enter on AP - will post my experience here.

Labor Substition was a devil which has created most of this problem as I can see there are hardly 15-20% original beneficiaries for these 2002-2003 Labors.
Employers made Labor Sub a Devil by misusing it. It has been provided to employers as a valid advantage from employer perspective.
Infact GC has become a retention perk for the employer and from the employer perspective all they need is unlimited H-1B permits. All this added to the fuel that GC has become a perk to the employee because they suck up 6 years of H-1B servitude and not a Employer benefit anymore.
I think the Govt and USCIS start to think now that
H-1B is employer benefit
GC is employee benefit
and they are slowly moving to make changes in the current law.

(I had posted a similar note a couple of weeks ago. I apologize for doing so again, but I feel this needs to be said).
We legal immigrants need to make our voices heard because 99% of the US Citizens do not know our (sad) story. Here are some highlights (nothing new to the users of this site):
1. Most of us are highly educated.
2. .. work hard (because otherwise why would our employers sponsor us).
3. .. follow all the laws and pursue legal immigration.
4. .. are deeply invested in this country - so many of us own houses, mutual funds, etc. that are investments in the Economy.
5. .. contribute to the society in a variety of ways including: paying taxes, inventing so much of the new technologies (especially in the computer industry).
It wouldn't be too hard to get statistics on how much employment-based immigrants contribute to the economy - number of companies started by former immigrations, number of patents filed, US citizens employed by such companies, correlation of the growth of the Computer Industry with Employment based Immigration. I believe a very strong case can be made in our favor.
And all we ask for is a fair shot at permanent residence in this country. Not only do we not get that, the process is opaque and we have NO idea how long it may take for us to navigate each one of the many stages of this process. The process is completely unbounded and we have no way to planning our lives.
I bet if the US Citizens at large find out what we go through day-to-day they would be appalled. One way to do so is to peacefully protest in public - perhaps outside the USCIS offices. It is probably a dumb idea, but I wanted to bring it up - let us not sell our selves short, there are a lot of us and if we combine our voices it would be loud enough to get to the right ears. I am sure we will see action.

What I did till now.
1) Contacted Senator/Congressman/Governor
2) Filled 7001 form for Ombudsman
3) Called USCIS 10 times in last 10 days and come to know that everything is cleared on my and wife applications.
4) Strange thing applied EAD on July 15th 2008 and got approved today august 12 2008.

Pl don't make blanket statements such as this. BTW, I contributed to DC advocacy and many other EB3s also did the same.

What the other post said is very true. We have 45000 members in this board, a significant majority of them are EB3. Even if 50% of the members 22000 (as an example ) contributed 25$ each, IV would have more than half a million bucks. With this money EB backlog plight could easily come out in mainstream media. Just because you, as a person, contributed does not mean all of EB people are contributing. Realizing our problem is the first step in solving it. Problem is people are not willing to contribute to IV, either their money or time, but want issues solved. Doesn't work that way..
