I did some research on murthy.com and found that AC21 did abolish 'per country of birth quota' on recycled numbers. I am posting a link to this murthy.com article of Oct 6, 2000 which clarifies the issue.

It is clear guys we have to concentrate our energy and our thoughts on this quota. Quota on the basis of "country of birth" on talent or skill needed is really hard to explain and we can have good logical arguments to support its abolition.

It will bring the priority date to current for a couple of years(even if there are more cases than unused numbers with them. Just because they cannot process that faster)

Vow quite a turnaround. First you say its you who want to do it and when you get the heat you claim otherwise.
Either way this is pure 'FRAUD' . If you are the person who is doing it USCIS will have ways to track it and it will come back during your Naturalization or at any time when u enter the country. If you are just trying to report this to authorities you can do so at your state DOL or write a letter to USCIS with details if you have it.

Guys,
I have approved EB3 LC and approved I 140 with PD JAN 2002. My wife has approved EB2 LC (Perm) and Approved I 140 with PD JAN 2006
As we represent one family can't my wife use my PD and apply I 485 under EB2.
for example If husband is born in a retrogressed country and wife in a non retrogressed country in that case, husband gets a free ride !
Why not in this case ? Just curious !
Only after one of your PDs becomes current, the other can piggyback. May be you could try PERM and reapply old PD to the new one.

Here is my situation.
Labor filed with company A in April 2006 and I-140 EB2 approved in May 2007. Could not file I-485 last year due to personal reasons.
Changed the Job to company B in Sep 2007.Company B filed PERM EB2 in Feb 2008 and got approved in Aril 2008. I-140 filed in June 2008 with priority date recapture request and still pending.
My 6th year of H1B is expiring in March 2009.
My question is, can I file my I-485 based on my previously approved EB2 I140.
What should be best approach for me? Any help will be greatly appreciated.

Is there any way to know if employer has revoked your 140. I have an approved 140 & pending 485. After filing 485 I left my company before completing 180 days. Its more than 9 months since I left my employer. Will the status change on USCIS web if 140 was revoked.

Hi,
vis-a-vis immigration, the burden of proof is on us not on the USCIS, reputed attorney like murthy always suggest to keep copies of I-94s at each stage to show proof of maintenance of status.
Try to collate as much info as possible. Since you have such a long history (H1-B etc) at each step of extension or transfer you must have submitted copies of original H1 documents valid at that time and also passport copies too, go back to those attorney/(s) and request copies form their files. As far as I-20's are concerned you need to talk to your school to get copies.

It is partly true. You get stuck in name check , somebody get stuck at I-140, All in all this whole system is purposefully created to keep doors locked "legallly". The first and foremost question should be how the hell government has decided 140000 visas not 40000 and not 240000 but only 140000 and why the hell discrimination against people from only 4 countries?
Infact employment based immigration is for sufficing the need of the market then let market decides what immigration numbers should be set as ceiling... If US economy need 7 milion in year 2007, ceiling should be 7 million and next year US market may need only 7000 then for that year ceiling should be 7000. I believe if they may freshen up the whole EB GC mess with starting restructuring based on this concept then only in future we can expect flawless legal immigration...

My primary tip is patience. When the wind is blowing, even slightly, if you're patient you will start to get in tune with the wind and be able to pick out the calm moments that always occur. You just have to be ready and then get off as many shots as possible during that calm moment. I shoot as many of my flower shots as I can very early or very late in the day. By very early, I mean at or just after sunrise. The wind is usually calm for a short while until the sun starts to heat the admosphere. I've had considerable success shooting in the very soft light at or after sunset, when the wind also calms. Long shutter speeds though. Unfortunately, too many blooms aren't open until the sun is higher in the sky and you have to resort to patience.
I've also had great success with a trick Don Bevis shared. You can get thin bamboo sticks in bundles for just a couple of dollars at your local nursery. Get the longer ones. I always carry two of them with me and stick them in the ground so that they apply slight pressure to the plant stem. This cuts down considerably on the movement. Don't know where Don learned the trick, but it works.
Some use a tool called a Plamp. See it here (http://www.naturephotographers.net/gs/gswimplamp.html) I've never used one, though have been tempted. The fear I have is that any clamping device will damage the plant. I shoot a lot in the gardens of several neighbors and at the Chicago Botanic Garden and make it a point to never leave any trace of my having been there. In other words, no footprints in the flower beds, no damaged plants, nothing. Don's trick works so well because it steadies the plant without causing any damage. It doesn't always work, but it does so often enough that it's worth hauling the sticks around.
I've also read several threads on other sites where people describe using "tents" to both diffuse the light and to stop the wind. I don't have any links for solid techniques, but will try to find some. It's tempting, though yet another piece of gear to carry.
These days I make heavy use of my 5-in-1 disk for diffusion and reflection. I have the 22-in. Photoflex Multidisc (http://www.bhphotovideo.com/bnh/controller/home?O=breadCrumb&A=search&Q=&ci=6196), which I like a lot. It's excellent for a lot of light control purposes and sometimes serves as a good wind block. There are cheaper ones, but Kevin Sadler talked me into spending more money to get a quality product and I haven't regretted it.
When all else fails, I resort to flash to get the shot. I greatly dislike using flash and only use it when I want a shot and know that it's get it now or never. If I can come back and get the shot at a calmer time without flash, I will. I do use flash on occasion if I feel that the shot needs a little spark of light, but generally not. Flash is always used on a remote cord and diffused in some way, either with the wide-angle diffuser that's built into it, or by shooting through or bouncing it off of my multidisc.
As for shooting technique, a tripod is a must. I have two, but the one I use for flower shots allows me to splay the legs out and get the camera very low and/or allows me to reverse the column (I bought a short column to replace the one that came with the tripod) and hang the camera upside down. I use a ball head with a quick release. I also almost always use a remote release and frequently use mirror lock up. It's amazing how many images I've ruined because I moved the camera by pushing the shutter button or vibration from the mirror cause the slightest blur.
But above all, getting flower shots just requires a lot of patience. Hope all of this rambling helps.

That is right my previous I-94 has expired and I should get the latest I-94 as part of new I-797. My US multiple visa expired last August.
My question is thoroughly answered that I could use the "Automatic revalidation rule" to come back into US using my I-94 and I-797.
One more question to the folks who became Canadian PRs. When I exit out
of US can they force me to give up I-94 as I am landing as Canadian PR. In others words,
can they override "Automatic revalidation rule" in this case.
Part of me says they are two different teams one working for US to track I-94
and the other looking for Canadian PR so they can never rationalize this. If they talk then that could be an issue. Isn't that right?

The info I got is I can not apply for 7th year based on the approved LC I have. But I can apply for 7th year based on the LC pending with PBEC. My problem is that LC applied in Marc 2005, is thr some other employer and I do not have any details of this application. I sent 3 emails to PBEC for screenshot which can be used as proof od pending LC and I can then apply for 7th year extension. But unfortunately I did not get any response from PBEC, I know some people get the response within 2-3 hrs from them????
Another possibility is if the pending I-140 is approved by Aug end I can apply for 3 year extension.
So I am totally uninformed what's the future. I talked with the lawyer who filed my earlier labor, she says we can demand for screenshot only in June, then we will get response from PBEC.

Positive PPD just means u are exposed to TB is the past ans CXR confirms that u dont have active disease .Treatment in this case is only optional and patient has to decide if he or she wants to be treated for that .Only people with HIV of other immune def dieases must be treated for pos PPD.

What is the exact reason for denial? In spite of your education evaluation as well as letter from the Registrar in India they still dont believe Maths was your major?
You should appeal. It can take a few months (4-6) but its not worth letting it go so easily. Try to get a better education evaluation done (try Sheila Danzig, she has helped some folks on immigrationportal.com). Also, ask your attorney why he is confident the appeal will work in your case (ie. what does he plan to present in the appeal that he did not include in the RFE response).
Also, start another LC in parallel if you are about to run out of your 6 years on H1, as a backup (you can get H1 extensions based on this LC while its under appeal, but if the appeal is also ultimately denied, you want to keep your options open)

I have come to this forum to ask for some advise because this is one of the forums where lot of the visitors are engineers, and most of them work in computers related fields.
I have a stable job( non-engineering) and I am making a decent salary(more than 200K/year) right now but I just hate my job.I desperatly want to change my field.
I am hoping to get my green card next year( PD 06/2004 NSC EB 2 India).I need your advise on how to get into computer/software/IT field.
I do not have an engineering background but am willing to go back to school. I would like to start working on this transition while I wait for my GC.
My questions are -
1- Is there a shortcut of getting into any computer/software or related field ?training,short courses, anything!
Absolutely, just have some experience with a Komputer software, they call Microsoft Outlook. Its actually a suite of products, Office, word and excel. It can get little tough initially, but as you know fruits will be bitter, when you get trained in such a tough course. Set aside 1-2 months in a week, for this.
2- If I have to go back to school what major will I need to take? Any specific requirements?
I'd not waste time for school. See 1. A simple course is sufficient.
3-I have a bachelors but not in engineering- can I go straight for a MS in computer science or will I have to do a bachelors in Computers first.
See 1. Dont spend anytime in MS or PhDs.
4-How's the current job market and and also if you have any idea/view about future job scenario?
Current job market is booming. You may have seen job losses in other fields, but in IT, its not the case. I was making $125K 3 months back and now I am switching jobs as I have 5 offers, offering me more than 200K. My employer is begging me to stay.
5-Have any of you made/seen such a transition at my stage?- I am 35, married with working spouse.
Absolutely, 50% in this forum are same like you. Me too.
6-Also if somebody can give an idea about salaries in computer related fields?

None of us here has little luck... We were close to CIR this year and now new math is in picture.. Two possibility for CIR in 2010...

The good part is as democratic party losses seats....the CIR lobby weakens and piecemeal will have better chance.
(1) Dems will not touch it.
(2) GOP will not support it because people will think Dems passed it and that will help them to win midterm election.
CIR was impossible all along. It was delusional to think such a political hot potato can pass.

Time and again - there are confilicting opinion from attorneys.
My attorney ( and i trust her) said that if you are maintaining H1/H4 status (not necessairly VISA stamped) . your I-485/I-131 doesn't get considered cancelled and only requirements that you must be in US while filing. Being on purely non immigrant VISA like F1/F2/B1 you must be in US on day of approval.
People normally refer to friend's example but i have 2 collegues whose spouses has done same thing. Spouse's H4 visa stamping is long expired but they were gone to India after filing AP and they have comeback without any issue.
If you have not extended ur H1-B/H4 (dual immigrant) and have take advantage on AC-21 then I believe that you are not maintaining any non-immigrant status and you are just paroled in.

Got the cards in the mail. My online case status says the application is still pending.

Check with your attorney, in your mail boxes along with the online USCIS case status. You may get the good news in your mail box or from your attorney's office before your status is updated online.
