As long as your sister is complying with the terms of her B-1 admission, she is entitled to begin work for the new employer as soon as that employer files an H-1 petition requesting a change of status on her behalf. Pay stubs from her original H employer should not be required. The language quoted below is from a Nov. 2000 USCIS Q&A:
"Q10: Who is eligible to use the H1B "portability" provisions?
A10: The portability provisions allow a nonimmigrant alien previously issued an H-1B visa or otherwise accorded H-1B status to begin working for a new H-1B employer as soon as the new employer files an H-1B petition for the alien. Previously, aliens in this situation had to await INS approval before commencing the new H-1B employment. These provisions apply to H-1B petitions filed "before, on, or after" the date of enactment, so all aliens who meet this definition can begin using the portability provisions.
Q11: Are there any other limitations on the portability provisions?
A11: An alien must have been lawfully admitted into the United States. I filed my 485 in August and got married later and my wife is on H4 right now. I'm on H1 as of now. I'm not using my EAD right now, so that my wife can maintain her H4 status. I'm planning her F1 processing from H4, so that once she is on F1 officially, I want to use EAD to change employers.
Is there any risk involved here and if so, please let me know

I don't understand why people are right now so worried about priority date retrogression. If you have passed 180 days after I140 approval, go ahead, change your job and incase your 485 gets denied, reapply with new employer, with new new job description, using old PD and get GC soon as your priority date will be current. Am I missing something?
There is no way I am going to spend 6-7 years in the same job with the same title(maybe even same company).

Some clarifications needed here !
1.) Data entry is not done by adjudication officers (AO)
2.) Unless an AO is trained in a particular "production line"
(I-485, I-765 etc.) they cannot move them around
3.) Bear in mind AO's have the option to and do work from home too.
4.) The adjudication rate per past service center reports is
around 2 or3 cases per hour for I-485
The assumptions here are all the 50 guys are working only on EB cases no family and other cases, they are not doing any other data entry job like putting 450/ead/ap applications into system, they are not approving any of ead/ap cases. And they are working 8 hours daily. Looking at the general work environment around i bet the productive hrs in 8 hr work day is around 5/6 hrs. So keeping in mind these factors i feel the 80000 is okay number. They certainly need more staff. My 2 cents.

I-140 approved, and more than 6 months since 485 application.
I just used my AP. Now can I change the employer on H1? I am hearing something that the latest I-94(that I got at POE last week) has my status as AOS, so the H1 transfer may not be possible. Is this true?
I am sure lot of the people has the same question. Can some clarify?

Dont Think only big companies will enforce NCA..now NCA's have become a source of revenue of consulting companies.If you are going to loose the case ,you will only pay their legal expenses.. Two of my friends are have done that and it took them 2 yrs of time and cool $30,000 dollars(from their own pockets) to settle at the end...
So Dont be over confident.Pay few hundred dollars to good attorny and get his legal opinion.

I would have liked another field which asks how much money has been moved away from USA due to uncertainty with the wait for green card.
Personally, I wish I had parked my savings money in USA, but due to green card limbo I ended up moving all that money outside to another country to invest.
Only reason, I am not sure where my life would end without knowing an answer to my green card application.
I think this is a key point which is missing in the survey.

Hi,
My pay on the employment letter given by my company is 10k more than wat is on my W2's.
My employer said it shld not be a problem as the W2's are for previous years and the employment letter is dated as of this year.
Is this fine or will there be in any problem with this.

Law abiding? I beg to differ. Application for asylum goes to court only if the petitioner spent more than one year illegally in the US.
That does not change the fact that the immigration system is broken, I just want to point out that what is considered to be "law abiding" or "law breaker" is aften very-very relative. We are all in the same boat.

If your application is in texas, they will not reject based on education for sure( i don't know about your company financial status) they are very liberal. If your application is in Nebraska they may send RFE for education evaulation (if you didnt submit it with your application).
On the whole don't worry about education column as your labor gives the flexibity of combining the degrees, you will get approval for sure if your company financial status is good.

I have a priority date of March 2004 (EB2 India) and I am still waiting for my Green Card. I think majority of the 2004 filers are in the same boat except for a lucky few who were able to get the green card after the July fiasco.
So don't buildup your hopes too high. I firmly beleive that very soon there will be a repeat of what we saw last year in July and the green cards will be distributed once again out of order.
So if you are one of those luck ones, you might get it.

So, sometimes your sources are wrong and relying them we tend to go wrong. Thats all to it.
However, iam of the view that we should believe all the sources both negative and positive and then make your educated guesees.
This is my guess
There will be relief but not to everyone.
USCIS/DOS will announce the news without an apology, but it will not please everybody.
They will accept few applications just to nake their case stronger and remove the teeth of AILF lawsuit.
USCIS/DOS is ready to take head on with AILF but only after making their asses stiff.
USCIS/DOS knows their bad deeds but is not passing all of it to its masters.
Masters are saying why we need to bend over, lets take on these immigrants.
At the end few will be fired and few will resign from USCIS and DOS with fewer I-485 applications accepted from July 2.
